These Terms of Use govern use of extcabinets.com and, when presented and accepted in connection with a purchase, the products and services supplied by EXT Cabinets LLC (“EXT Cabinets,” “we,” “us,” or “our”). Please read them before using the website or approving an order.

We manufacture custom outdoor cabinetry, sell outdoor kitchen products and accessories, and offer agreed installation services for Florida residents. Contact us at info@extcabinets.com, 561-300-0176, or 1700 Park Ln S, Unit 3, Jupiter, FL 33458.

1. Eligibility and acceptance

Purchasers and subscribers to our text messaging program must be at least 18 and legally able to enter into the relevant agreement. If you act for a business or another person, you represent that you have authority to do so. By signing or electronically accepting a proposal or order that incorporates these terms, you agree to these terms as part of that transaction. If you do not agree to the website-use provisions, discontinue use of the website.

Acceptance of general terms does not by itself constitute consent to receive text messages. Our optional SMS program requires a separate affirmative opt-in.

2. Order documents and scope

The accepted written proposal, order, final approved drawings, and written change orders identify the products, specifications, prices, and services included in your purchase. An order acknowledgment or payment receipt alone does not substitute for final design approval or confirm that unlisted work is included.

If documents conflict, a specific provision expressly agreed in a signed proposal or later accepted change order controls over a general provision of these terms for that subject. Final approved drawings control the agreed design specifications. The written product warranty applicable at purchase governs warranty coverage. Mandatory legal rights are preserved in all cases.

Only expressly listed products and services are included. Illustrations, photographs, and renderings may show appliances, countertops, accessories, or site work that are not part of the quoted scope. Website revisions do not retroactively change an accepted order or its warranty.

3. Pricing, payment, and financing

A deposit equal to 50% of the cabinetry purchase price is required to begin the order process. The remaining cabinetry balance is due when the cabinets are complete and before shipment or release for delivery. Appliances must be paid in full before we place the appliance order. Any separately agreed installation or other service payment schedule will be stated in the accepted proposal.

Prices are in U.S. dollars. Applicable taxes, pallet fees, shipping charges, and other agreed charges will be identified in the quote or order. You must provide accurate payment information and authorize only payments you are entitled to make. Payment processing is provided through Helcim or another payment method we expressly accept for your order.

Financing through Synchrony is subject to the financing provider’s approval and separate terms. We do not guarantee approval, a particular rate, or a promotional offer. Any financing promotion is subject to the disclosures and eligibility requirements supplied for that offer. The accepted order and financing agreement will determine how approved financing satisfies the required payments.

We may correct website pricing or description errors before accepting an order. If an error affects an order already submitted or paid, we will notify you and seek your agreement to a correction or provide an appropriate cancellation and refund as required by law; we will not impose an unapproved price increase.

4. Design approval and customer information

Custom cabinetry production requires approval of the final design and applicable order terms. Before approving, review dimensions, configuration, colors and finishes, door and drawer arrangements, appliance models, cutouts, access requirements, and other specifications shown in the order documents.

We may rely on measurements, photographs, appliance specifications, and other information supplied by you or your contractor unless we expressly agree to verify them. You are responsible for the accuracy of information you supply and for communicating changes before production. Your approval does not excuse our manufacturing errors or responsibilities we expressly assume, including measurements we undertake to provide.

Renderings illustrate the proposed design and are not architectural, structural, electrical, plumbing, gas, or permit drawings unless expressly identified as such in the accepted scope. Product colors may appear different on different screens; request available samples when color selection is important. This does not authorize us to substitute a different agreed product or finish without your approval.

5. Changes, cancellations, and production timing

Changes after design approval require our written acceptance. Before changed work proceeds, the written change order must identify any revised specifications, charges, and schedule. Some changes may be impractical after materials are ordered or production begins.

Submit cancellation requests promptly in writing to info@extcabinets.com. If you cancel your custom cabinetry order after production has begun, you forfeit the 50% cabinetry deposit, to the extent permitted by applicable law. This restriction reflects the custom nature of the work and applies to voluntary customer cancellation, not to a cancellation or refund remedy required by law for our breach, defective or nonconforming goods, or a qualifying shipping delay. Cancellation before production and cancellation of appliance orders are governed by the specific conditions disclosed and accepted for those orders and applicable law. The custom-product return restriction below is separate from cancellation before fulfillment.

Production and shipment timing depends on approved specifications, required payments, material and appliance availability, and the agreed scope. Estimated dates are not guaranteed completion or installation appointments unless expressly agreed in writing. If an applicable shipment deadline cannot be met, we will provide required delay notices and cancellation or refund options and obtain consent to delay where required by law. Supply interruptions and other events beyond reasonable control do not eliminate those obligations.

6. Shipping and pallet fees

Orders over $5,000 qualify for free standard freight shipping within the contiguous 48 United States. A separate fee of $200 per pallet applies, including to orders qualifying for free freight shipping.

Eligibility is based on the merchandise subtotal after discounts, including appliances, and excluding pallet fees and taxes. The qualifying subtotal must exceed $5,000. Pallet fees do not count toward the threshold. The written quote or order will identify the applicable pallet quantity and total pallet fees. Orders not qualifying for free standard freight shipping are quoted separately. Shipping outside the contiguous 48 states is not included in this offer and requires a separate accepted arrangement.

Standard freight delivery is curbside. It does not include moving products into a home, garage, backyard, or installation area, unpacking, assembly, installation, or packaging removal. Arrange suitable assistance and equipment to move products safely from the curbside delivery location. The accepted quote will identify any liftgate, restricted-access, or other additional delivery services and charges. Additional services requested after acceptance require an agreed adjustment. We will not treat an undisclosed charge as accepted merely because the cabinets have been manufactured.

Provide accurate delivery information and coordinate access and appointments with us and the carrier. Keep the shipment tracking information and arrange appropriate help for the delivery service specified in your order.

7. Delivery inspection and damage

Inspect the shipment promptly. When reasonably possible, note visible damage or shortages on the delivery receipt before signing, take photographs, and retain packaging. Report visible freight damage to info@extcabinets.com within 48 hours of delivery when reasonably possible, with your order number and photographs. Report concealed damage promptly after discovery.

Prompt documentation helps us investigate and pursue carrier claims. A delivery signature or failure to discover concealed damage immediately does not automatically waive applicable warranty rights or other rights protected by law. Do not install a visibly damaged or incorrect item before contacting us for instructions unless necessary to protect people or property.

8. Custom cabinets and appliance returns

Custom cabinets are made to the approved specifications and are not eligible for returns or exchanges based on a change of mind, preference, or inaccurate customer-supplied information. This restriction does not eliminate remedies for defective goods, shipping damage, our manufacturing errors, goods that do not conform to the approved order, or rights that cannot lawfully be waived.

Unused appliances in new condition may be returned with our prior authorization, subject to a restocking fee equal to 30% of the returned appliance’s purchase price after discounts. Appliances must be in their original, undamaged factory packaging with manuals, accessories, and packing materials. The customer pays return freight for a change-of-mind return. Any applicable return request period must be disclosed before purchase in the accepted order or our Returns and Refunds Policy. We will not impose an undisclosed return deadline retroactively.

The 30% restocking fee does not apply when the return results from our shipping an incorrect product or where charging it is prohibited by law. Defective, damaged, and nonconforming products are handled under the applicable warranty and legal remedies, rather than automatically treated as change-of-mind returns. We cover return shipping for an incorrect appliance we supplied. Contact us for instructions before shipping any item back. Return authorization procedures do not limit rights that cannot be waived under applicable law. Approved refunds are issued to the original payment method, subject to applicable financing arrangements and legal requirements.

Any additional return restrictions or charges must be disclosed before purchase and cannot be introduced retroactively. Warranty claims are governed by the applicable written warranty, not solely by change-of-mind return rules.

9. Installation and site responsibilities

We offer installation for Florida residents, subject to confirmation of availability and an accepted written scope and price. Installation is included only when expressly listed in the proposal. Customers must separately arrange any installation outside our agreed scope.

The accepted proposal will allocate responsibility for cabinet placement, countertops, appliance installation, utility connections, permits, site preparation, and related work. Do not assume that purchasing cabinets includes gas, electrical, plumbing, structural, or countertop work. We remain responsible for work we expressly agree to perform.

Installations must follow applicable codes, approved specifications, and the relevant cabinet and appliance manufacturers’ instructions, including required clearances, ventilation, protective components, anchoring, and support. Use properly qualified and licensed professionals where required. Do not modify cabinets or install cooking appliances in a manner inconsistent with the relevant instructions.

Coordinate countertop measurements and installation after the cabinets are properly positioned and leveled, unless the project professionals specify an appropriate alternative. You are responsible for independently retained contractors, but this does not release us from responsibility for our own work, products, or contracted services.

10. Product warranties

Applicable EXT Cabinets product warranties are described in our written Warranty. Review the warranty before purchase. The version applicable at the time of purchase governs that purchase; subsequent changes apply prospectively.

Third-party appliances and other products may have separate manufacturer warranties. Those warranties do not eliminate obligations that applicable law places on EXT Cabinets as seller. Website-use disclaimers in these terms do not cancel an express product warranty or disclaim implied warranties where doing so is prohibited.

Contact us with proof of purchase, a description of the issue, and photographs where useful. Nothing in these terms removes consumer rights or remedies that cannot lawfully be excluded.

11. Website content, designs, and customer materials

Our website content, branding, photographs, and original design materials are owned by us or our licensors. You may use the website and supplied project materials to evaluate our products and coordinate your authorized project. This permission does not authorize reproducing our designs for competing manufacture, reselling our content, or using our trademarks without permission.

You retain ownership of materials you provide. You grant us a nonexclusive permission to use those materials as reasonably necessary to evaluate, design, fulfill, document, and support your project. You must have authority to provide them. Sending private project photographs or drawings does not give us unrestricted permission to publish them for advertising; we will obtain separate permission for that use.

If you submit a review for public posting, you grant us a nonexclusive permission to display and reproduce it in connection with our products and services without materially misrepresenting its meaning. Nothing in these terms prohibits honest reviews, lawful complaints, or communications with regulators, or requires transfer of ownership of a review. We may address unlawful, fraudulent, abusive, or privacy-infringing content consistent with applicable law.

12. Acceptable website use and third-party links

Do not use the website to commit fraud, impersonate others, upload malicious code, interfere with security or operation, access restricted systems without authorization, or infringe another person’s rights. We may restrict website access to address misuse or security risks. Restricting access does not cancel our obligations under an accepted order or applicable law.

Third-party websites and independent services have their own terms. Linking to them does not make us responsible for their independent operation. This provision does not disclaim our responsibilities for products we sell or services we contract to provide. Our Privacy Policy explains our handling of personal information.

13. Customer text messaging program

Program and consent. EXT Cabinets LLC offers optional customer-service and order-related text messages through GoHighLevel and Twilio. By affirmatively opting in, you authorize us to send these messages to the number you provide, including using automated technology. Providing a telephone number, purchasing products, or signing general terms does not by itself enroll you. Text message consent is not a condition of purchase.

Message types. Messages may concern your inquiries, requested estimate information, design approvals, order confirmations, production, invoices and payment reminders, shipping, delivery, installation scheduling, and customer support. This program does not include promotional text messages.

Frequency and charges. Message frequency varies with your inquiries and order activity. Message and data rates may apply to messages sent and received. Contact your wireless provider about your plan.

Opting out. Reply STOP to a program message to unsubscribe. You may also email info@extcabinets.com or call 561-300-0176. We honor other clear requests to stop receiving messages. You may receive one nonpromotional confirmation message. Further program messages will stop unless you subsequently provide new consent. Opting out does not cancel your order or change payment obligations; we may communicate about your order through other appropriate channels.

Eligibility and number changes. You must be at least 18 and the subscriber or authorized user of the number provided. Notify us if you change or relinquish that number. Re-enrollment after opting out requires new consent.

Delivery and carriers. Delivery depends on network and other conditions and is not guaranteed. Carriers are not liable for delayed or undelivered messages.

Privacy and changes. Our Privacy Policy explains mobile information and consent protections. We may update or discontinue the program, with notice and new consent when required. Updating these terms does not expand your existing consent.

14. Website availability and limitations of liability

The website is provided on an “as available” basis. We do not guarantee uninterrupted or error-free website operation. General website information is not a substitute for approved project specifications or qualified installation advice. This website-availability provision does not disclaim warranties or performance obligations for purchased products and services.

To the extent permitted by law, neither party is liable to the other for indirect, special, or consequential losses arising from an order, including lost profits or loss of business opportunity. To the extent permitted by law, our total liability for claims arising from an order is limited to the total purchase price paid or payable under the affected order.

These limitations do not exclude or limit liability for fraud, willful misconduct, gross negligence, personal injury, death, or any liability or remedy that cannot lawfully be limited. They do not reduce expressly promised warranty performance, required refunds, or other nonwaivable rights. Where applicable law does not permit a limitation, that limitation does not apply. No limitation here shifts responsibility for our own wrongful conduct to a customer.

15. Disputes and governing law

Please contact us first about a concern so we can attempt to resolve it. Neither contacting us nor attempting informal resolution is a condition of pursuing a legal right, and informal discussions do not extend a legal deadline unless agreed in writing or provided by law.

Florida law governs these terms, subject to applicable federal law and mandatory protections available under other applicable law. Unless mandatory law requires otherwise, disputes under these terms will be brought in a state court in Palm Beach County, Florida, or the federal court with jurisdiction over that county. Nothing here restricts a consumer’s nonwaivable right to use another forum or contact a government agency.

These terms do not require mandatory arbitration, waive participation in a class action, or shorten an applicable statutory limitation period.

16. Electronic records and updates

Where permitted by law, proposals, approvals, change orders, and other transaction records may be accepted electronically. Keep copies of the documents you approve. We will provide notices and obtain consent in the form required by applicable law; this section does not waive statutory requirements for particular notices or authorize unsolicited text messages.

We may revise these terms for future website use and transactions. Material changes will receive notice where required. Changes do not retroactively alter an accepted purchase, warranty, or messaging consent. If a provision is unenforceable, the remainder continues to apply to the extent permitted by law. A failure to enforce a provision on one occasion does not waive it on another.
